Terms of Service — Luther's Diamonds

Welcome to Luther's Diamonds. By accessing our website, placing an order, or otherwise using our services, you agree to be bound by these Terms of Service. Please read them carefully — they cover important details about our products, custom orders, payments, and the rights and responsibilities of both you and Luther's Diamonds.

1. About Luther's Diamonds

Luther's Diamonds is a family-owned jewelry studio based in Atlanta, Georgia, specializing in handcrafted engagement rings, wedding bands, and bespoke fine jewelry.

2. Acceptance of Terms

By using our website, placing an order, submitting a custom design request, or otherwise interacting with our services, you confirm that you have read, understood, and agreed to these Terms of Service. If you do not agree, please do not use our website or services.

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase from Luther's Diamonds.

3. Products & Pricing

All jewelry sold by Luther's Diamonds is handcrafted to order. Because each piece is made by hand, minor variations in metal finish, stone characteristics, and proportions may occur and are part of the nature of bespoke craftsmanship.
Product images on our website are intended to represent each piece as accurately as possible, but actual items may vary slightly in appearance due to lighting, screen calibration, and natural stone variation.
Prices are listed in U.S. Dollars unless otherwise noted. We reserve the right to update pricing at any time. The price applicable to your order is the price displayed at the time of checkout.
Stone certifications (GIA, IGI, GRC, and others) are provided where applicable. Specific certification details for each piece are described on the product page or in your custom design quote.

4. Orders & Payments

Order processing: Standard made-to-order pieces enter production once payment has been received in full. Estimated production time is approximately 4 weeks (2–3 weeks production, 1–2 weeks shipping). Detailed timelines are outlined on our Shipping & Care page.
Custom orders: Bespoke and custom design orders require a 10% non-refundable deposit to begin the design and CAD process. Production begins once the remaining 90% balance is paid in full. Custom orders typically take 4–6 weeks after full payment is received.
Payment methods: We accept major credit and debit cards, Apple Pay, Google Pay, Shop Pay, PayPal, and approved financing partners.
Currency conversion and international fees: International customers are responsible for any currency conversion fees, import duties, taxes, or customs charges imposed by their country.
Order acceptance: All orders are subject to acceptance by Luther's Diamonds. We reserve the right to refuse or cancel any order, including for reasons such as pricing errors, suspected fraud, or inability to verify customer identity.

5. Custom Design Orders

Custom design orders are a collaboration between you and our team. To set clear expectations:

A 10% non-refundable deposit is required to begin the design and CAD process. This deposit covers the design work our team performs from the moment you commission a piece — it is not refundable once design work has begun.
You will have the opportunity to review the CAD rendering and request reasonable revisions before manufacturing begins. After CAD approval and final payment, the piece enters production and the design is considered finalized.
Once production begins, custom orders cannot be cancelled or refunded. See our Returns & Order Support page for full details.
You are responsible for providing accurate specifications (ring size, stone preferences, engravings, etc.). Errors caused by incorrect customer-provided information are not the responsibility of Luther's Diamonds and may require additional fees to correct.

6. Shipping, Risk & Insurance

Full details about our shipping practices, insurance coverage, and care promise are available on our Shipping & Care page. In summary:

All packages ship via trusted, signature-required carriers and are fully insured through Shipsurance for the duration of transit.
Delivery timeframes are estimates. Luther's Diamonds is not responsible for delays caused by carriers, customs clearance, weather, or other circumstances outside our reasonable control.
Risk of loss: Once a package has been accepted by the carrier, responsibility for the shipment transfers to the customer. Our Shipsurance coverage remains in place to protect against loss or damage during transit, provided original packaging is retained for any claim (see Shipping & Care page).

In summary:

Because every piece is handcrafted specifically for you, all sales are final once production has begun.
Return requests for shipping damage, incorrect items, or confirmed manufacturing defects must be submitted within 14 days of delivery, with clear photos and your order number.
CAD design deposits are non-refundable once design work has begun.
Every piece is covered by our Lifetime Warranty for manufacturing and craftsmanship defects, plus one complimentary resizing per ring.

Our liability for any approved claim is limited to repair, replacement, or refund at our discretion.

8. Intellectual Property

Our intellectual property: All content on the Luther's Diamonds website — including text, images, photographs, videos, logos, designs, CAD renderings, branding, and the Stone Inlay® feature — is the intellectual property of Luther's Diamonds, protected by U.S. and international copyright, trademark, and trade secret laws. You may not reproduce, distribute, modify, or use our content for any commercial purpose without our prior written consent.

Custom design ownership: When you commission a custom piece from Luther's Diamonds:

All designs, sketches, CAD files, technical drawings, and other intellectual property created by our team in the course of designing your piece remain the property of Luther's Diamonds.
Upon final payment, you receive ownership of the physical ring or piece itself, along with a personal-use license to wear, photograph, gift, insure, resell, or otherwise enjoy the physical item.
Luther's Diamonds retains the right to recreate similar designs, display the design in our portfolio and marketing materials, and use the design as inspiration for future work, including for other customers.
You agree not to reproduce, replicate, or commission a third party to reproduce a custom design originally created by Luther's Diamonds.

If you wish to commission a design with exclusivity protections (i.e., a design that will not be recreated or shown publicly), please contact us before placing your order to discuss bespoke exclusivity terms.

9. Customer-Submitted Content & Marketing Permissions

We love seeing the moments our pieces become part of — proposals, celebrations, weddings, and milestones.

If you tag us on social media (@luthers_diamonds) or share photos directly with us, we may reach out to ask if we can feature your content on our website, social media, or other marketing materials.
We will always request your explicit permission before using any photo, video, or testimonial that identifies you, your loved ones, or your private moments.
Reviews submitted on public review platforms (such as Trustpilot or Google) may be quoted, screenshotted, or shared as part of our marketing, in accordance with those platforms' terms of service.
You retain ownership of any content you submit. When you grant us permission to use specific content, you grant Luther's Diamonds a non-exclusive, royalty-free license to use, reproduce, and display that specific content for marketing purposes, with attribution to your first name or social handle unless you request otherwise.

10. Acceptable Use of Our Website

By using our website, you agree not to:

Engage in fraudulent activity, misrepresentation, or unauthorized use of our services.
Post or transmit harmful, defamatory, obscene, threatening, or unlawful content.
Attempt to gain unauthorized access to our systems, customer accounts, or back-end infrastructure.
Use automated tools (bots, scrapers, etc.) to access, copy, or interact with our website without prior written permission.
Interfere with the proper functioning of our website or services.
Use our website to impersonate any person or entity.

We reserve the right to restrict, suspend, or terminate access to our services for any user who violates these terms.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

Luther's Diamonds is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website, products, or services — including but not limited to lost profits, lost data, business interruption, or emotional distress.
Luther's Diamonds is not liable for losses or delays caused by circumstances beyond our reasonable control, including carrier delays, customs holds, natural disasters, supply chain disruptions, or technical failures.
Our total cumulative liability for any claim arising out of or related to your purchase is limited to the amount you paid for the product or service in question.

Nothing in these Terms is intended to limit any rights you may have under applicable consumer protection laws that cannot be limited by contract.

12. Indemnification

You agree to indemnify and hold harmless Luther's Diamonds, its owners, employees, contractors, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms of Service, (b) your violation of any law or third-party right, or (c) your misuse of our website, products, or services.

13. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict-of-law principles.
Any disputes arising out of or related to these Terms or your use of our services will be resolved exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to the personal jurisdiction of those courts.
Before pursuing legal action, we encourage you to contact us first at info@luthersdiamonds.com so we have the opportunity to resolve the issue directly. Most concerns can be addressed through a simple conversation.

14. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our practices, services, or legal requirements. When we make material changes, we will post the updated Terms on this page and update the "Effective" date at the top. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
